Do Restaurants Have to Pay Minimum Wage?

Debates

How about strippers? Do they get min wage too? Some of them can bring in 500, even a thousand dollars a night in unreported income . Bartenders/cocktail waitresses/parking valets in high end casinos in Vegas, etc. can also get huge amounts of $ for a busy shift.

Denying anyone minimum wage because they receive tips is running a scam. It's no business of the restaurant whether tips are received by the server.

The idea reeks of corporate lobbying that was probably dressed up as fighting for mom & pop shops.
The minimum wage assures that you are getting paid a minimum amount. It certainly does not matter where the money comes from. I do however agree with you that tips are a scam ... the recipient is pocketing it and not paying taxes and is scamming the rest of the general American public which is entitled to income taxes on their earnings.

Real estate brokers who make 6 figures have successfully sued for hours they did not make money even though overall they are more than fairly compensated for their work. The minimum wage law often is a sword of already compensated employees to double-dip.

Several things wrong with your post:

1) Working for tips does not assure you get a minimum wage. Tips are entirely provided at the whims of the customer. Furthermore, if business is slow that day, you may not have any customers to even get tips from. Businesses who expect employees to work for tips are running a scam.

2) Tips are required to be reported and there are even specific sheets to do so.
Prediction: You're going to say something like "well I bet they lie on their taxes". Well, so do the rich. If you care about cheating on taxes, go after the rich and let the incomparably poorer restaurant workers have a minimum wage.

Yes. Everyone should be guaranteed a minimum wage.

Real estate brokers?
Brokers work for themselves as independent agents, who would they sue, themselves?

Can stock brokers that lose millions and get no commission sue for minimum wage?

You are ignoring reality:

1. The overwhelming majority of times people make waiters/ waitresses make far more than the minimum wage in the US as 15% tipping is customary

2. The overwhelming majority of the time the cash received is severely underreported if reported at all. It allows workers to steal cash and even illegally qualify for governmental benefits.

Well if you get no commission and you are an employee then you would normally be entitled to minimum wage regardless of whether or not your trades make or lose money.

It's still doesn't absolve the restaurant of their responsibility to pay minimum wage. This is merely an excuse by businesses to boost their own profits.

Yes I've worked commission jobs and if you get nothing you are given minimum wage but if that happens after two months you are invited to go work at Taco Bell.

It does absolve restaurants from paying a minimum wage because the statute understands that people who get paid from tips already are receiving sufficient compensation and therefore they have a lower minimum. The law understands reality. Whether a customer pays $9 for a meal and $1 for a tip or $10 for a meal and $0 for a tip but the owner of the restaurant has to pay the extra $1 is the exact same situation. The only difference is the tips allow employees to avoid taxes and make a frivolous argument that they should be able to double-dip by getting a high base salary and keep their tips.

I have no idea what a reasonable amount of time is but I am glad that you got your full compensation.

The vast majority of restaurant customers don't pay cash anymore except in fast food ones where they rarely tip.

So you are greatly exaggerating the "problem" under present realities.
