It makes no real difference; false statements under 18 USC sec. 1001 or lying under oath (perjury) under 18 USC sec. 1621 have the same penalty; a fine or up to 5 years in prison or both.

Yes but only if these codes apply, AND the burden of proof differs, thus the difference in charges applied.
