It was statutory rape which means the girl most likely was a willing participant.

He was just too old for her. I think he was 19 and she was 14. If the guy was also 14 it would not be considered rape at all.

what part of "she asked him to stop" didn't you get? do you have any evidence that is not true? or you're being a scumbag again?

no1marauder should be here any minute saying it's alright because the judge acted within legal limits.

Unfortunately for many activists, this case isn't quite as egregious as certain activists would like to claim. First, statutory rape is quite different from traditional rape.
The last paragraph of the New York Times (https://www.nytimes.com/2017/02/06/us/sex-marriage-ban-idaho-man.html?_r=0article) "The age of consent in Idaho is 18. Though the state does not use the term “statutory rape,” Mr. Herrera’s rape charge is based on a subsection of the law related to age, Mr. Loebs said" (prosecutor)
Furthermore, "the girl told the authorities that she had lied and told him she was 16 when she met him in 2014, according to The Times-News. He was 17 at the time." Many people would feel a 17 year old and 16 year old together sexually is not a big deal.
Finally, she accused told authorities that she "asked him to stop when he touched her breasts. But he continued, removing both of their clothes and sexually assaulting her."

I'm not sure what the punishment should be for sexual assault or whether this is an appropriate punishment. But a mandated six month rehabilitation program and the option of probation based on his success in the program could be more appropriate than 5 to 15 years or jail.

No one has anything more than what made it into the news--- except for the two people involved.
We have a pretty good idea, however, that she was at least interested enough to:
1.) lie about her age; and,
2.) continue with the relationship despite her mother's objections--- enough even, to secret him into her bedroom that night.

He was 17 at the time. The girl told him she was 16. They hung out
with friends, went to the mall, and communicated via Facebook. But
when her mother found out about the relationship, she tried to put a
stop to it.
