Game 3809362 was declared a draw without my (black's) consent. There are only 12 1/2-moves recorded since the last pawn advance or poece exchanged. I'd like to know if there is a legitimate way for this unilateral declaration of a draw to be achieved.

Ask him/her.

well in live tournaments i have experienced that the player hwo wishes to claim a draw must claim it himself. But many chess programs the draw is automatic just as if it had been stalemate
