    Here is another:

"Dershowitz insisted that a Senate trial "will not happen" regardless of when the House votes to impeach Trump, claiming that Senate rules would prevent a trial from starting until 1 p.m. on Jan. 20, which would be one hour after Trump leaves office."

As you can see Dershowitz is claiming a senate trial will not happen. That is what he is claiming. We will see if there is a trial in the senate.

Care to make a bet on it?
    You'd lose.

Mitch McConnell will soon be out as Senate majority leader; do you really think Chuck Schumer is going to pass on having a Senate trial after every Democrat in the House supported impeachment?

The YouTuber LegalEagle handled this well:

    - It's extremely unlikely that Pres. Trump would be able to actually be convicted of criminal charges of inspiring a riot, the actual law. His political speech is protected and there's just no way that a sane court would create a new precedent of prosecuting people or vague speech.

-[i]They can basically impea ...[text shortened]... old any of this "inciting a riot" business as a criminal charge that will stick and a new precedent.
Len Niehoff, professor at the University of Michigan Law School, disagrees and argues that what Trump did would be punishable under the Brandenburg test already mentioned:

"The Court held that speech like Brandenburg’s could be criminally punished only where “such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.”

This standard has lots of requirements. The speech must be directed toward producing action. It must be likely to result in such action. The action must be unlawful. And the action advocated for must be imminent."

"Was the speech directed toward action? And was the action to be performed imminently? Yes, and yes. Trump told his followers to march to the Capitol after his speech.

Was the advocated action unlawful? This is a closer question.

It is not unlawful to march to the Capitol. But what did Trump want his followers to do once they got there?

Trump said nothing to distance himself from the earlier comments of Donald, Jr., who said “We’re coming for you,” or Rudy Giuliani, who called for “trial by combat.” Instead, Trump built on the agitation they had fomented.

He made repeated claims that the election had been stolen from them. He declared that those gathered were “not going to take it any longer.” He exclaimed “we will never give up, we will never concede … we will stop the steal.” He instructed the audience that they had to “show strength” and “be strong.” And he told them that Vice President Pence could change the outcome of the election if he were only persuaded to do so.

The unmistakable message was that people should go to the Capitol and disrupt the proceedings in an attempt to keep Trump in office. And that is unlawful conduct on several fronts.

That leaves us with just one final question. Were the events that followed the likely result?

No. They were the inevitable result."

That would set a dangerous precedent. Are democrats going to impeach Ted Cruz so he cannot run in 2024 next? How about Hawley?

If you don't have to be POTUS to be impeached anyone can be impeached to prevent them from running. We will be like Iran. Excluding people from running will become the norm.

Conviction seems unlikely. I doubt you have the votes for it. This will make a Trump 2024 win more likely. Democrats are shooting themselves in the foot over Trump derangement syndrome.

A trial in the Senate has never happened yet. Nixon resigned first. Trump will not resign. He knows you don't have the votes.

MB: A trial in the Senate has never happened yet.

Wrong; one happened in Trump's term as a matter of fact.

Prior to Trump, there were 15 Senate impeachment trials including two of Presidents. https://en.wikipedia.org/wiki/Impeachment_in_the_United_States#List_of_formal_impeachments

    No you dope.

Only a senate trial can dish out punishment and you don't have the votes.

If a senate trial happens it may lead to the impeachment of Kamala Harris after 2022 if the republicans take back congress. She incited a BLM riot.

The problem you and Dershowitz have is that there is a sizeable faction ( headed by McConnel ) who want Trump impeached for reasons of their own internal party politics.
There is a lot more to come out of the investigation and the net might gather in some Republican extremists / opportunists like Hawley and I’m not talking about a congressional investigation.

    Oh for crying out loud!

    House: impeachment if sitting official
Senate: punishment or not. Official need not be sitting.

It’s that bloody simple you, ignorant, paranoid residue of something your daddy squirted on a rat which your mother sat on.

You don't remember things that happened a little over a year ago? https://en.wikipedia.org/wiki/Impeachment_trial_of_Donald_Trump

Senators can't be impeached (that was settled more than 200 years ago).

Neither can "anyone". If you ever read the US Constitution instead of the Epoch Times, you'd know this.

We'll see what the votes are after a full trial. Trump winning in 2024 is a Trump adorer's wet dream even if the Senate fails to convict.

    Try reading the constitution.

Have the house impeach him 10 times. They don't have the power to punish. Without a conviction the house impeaching is merely symbolic.
