the old indian has 4 on going games for my clan and hasn't moved in months
my question is why is he not timed out

Not everyone will take skulls.
Another possibility is that the player's opponents may not have even noticed the skulls, especially if they have a lot of games on the go.
My filter is set to "games awaiting my move" so I don't see skulls unless I actively look for them.
I would try pm's to the players who haven't timed him/her out and ask them to do so.
I read something about old indian a while since.
I think it was to do with having multiple accounts but can't swear to that

Well he was accused of having them, but don't think it was proven or he would be banned.

I think it has to do more with the 4 games no one has made a move on either side. Of course you should know more about this as a I believe you were a Clan Leader in the past?
